Terms and Conditions of passengers.

  1. Application

These conditions apply whether a contract has been made verbally or in writing.

The company acts on behalf of all the passengers travelling on the vehicles.

If the company is a group or partnership, an individual must be named as a responsible person. 

The company is responsible for the actions and decision of all the passengers on board including any additional costs incurred in performing the contract whether or not they actually travel with the party, the company will accept instructions from the passengers or their nominated representative. 

The company has the rights to advise the passengers at anytime verbally of all significant terms, making a booking will be deemed to signify acceptance of them.

2. Quotations

 Quotations are given on the basis of the direct route and on the information provided by the passengers. The route used will be at the discretion of the company unless it has been particularly specified by the passengers in which case it will be clearly shown on the confirmation. 

All quotations are given subject to the company having available suitable vehicle at the time the passengers accepts the quotation. 

The passengers cannot assume the use of the vehicle between outward and return journey, nor that it will remain at the destination for them, unless this arrangement has been agreed with the company in advance. 

The company reserves the right to levy additional mileage or time to that agreed. The charge will be pro-rata and in accordance with the formula advised on the booking confirmations.

3. Booking Process

The vehicle will depart at times agreed by the passengers and it is the responsibility of the company for all passengers at those time.

4. Lost Property

The company may will not accept liability for any losses incurred by passengers who fail to follow instructions given by the company.

5. Vehicle Capacity

The company will, at the time of booking agree and specify the legal seating capacity of the vehicle to be supplied. The company must not over load the vehicle beyond this capacity.

6. Responsibility of the Transportation Services

The driver is responsible for the safety of the vehicle at all times and as such may remove any passenger whose behaviour prejudices safety or is in breach of the company agreements.

7. App Based Bookings 

Normally a confirmation text is sent by the company for the passengers letting them know that their booking has been accepted.

8. Booking Cancellations

In event of any emergency riot strike stoppage or restraint of labour or anything happening of any event over which the company has no control (including adverse weather).

The company may be returning all money paid without any hesitation. While all party will be notified within 48 hours.

9. Complaints

In event of the company’s services, the company should endeavour to seek solution at the time by seeking assistance from the driver, If this has not provided a remedy, all complaints should be submitted in writing within 14 days of the termination day of the passengers.

The company will acknowledge all complaints within the time period of 14 days and will normally reply within 28 days.

10. New Payment Method

The company payment method are by credit card, bank transfer or the passengers can call to be paid over the phone if they wish.

11. Sub-Contracting

Where the company hires vehicles from other operates at the request of the passengers and where the company arranges as and when required.

If the company cannot accept the passengers booking due to any reason or the other, or shortage of driver at the time of booking, the company will call to other neighbouring companies that are fully licence to fulfil the booking.

The company attach a flow chart for demonstration purposes.

12. Notifications. 

Once a confirmation has been issued to the passengers the company reserves the vehicle. Giving the passengers time to cancel the booking subject to notifying the company.

13. Vehicles Checked

All vehicles at the company are subject to full vehicles checked, document verification before being employed by the company.

14. Driverless Vehicle

The company will plan the route and schedules in advance to ensure that each customer booking are correct.

The company will be pleased to make provision for this vehicle as and when required, it is a challenge but the company are looking forward and will be making all necessary provision.

These terms and conditions of agreements apply to all drivers transportation of passengers of West London Cars, and should read in conjunction with the particular terms of agreement that are appended to these agreements.

Acceptance of Bookings

West London Cars, is a private hire operator licence service, by TFL, this enables us to accept bookings, for private hire vehicle, we provide the driver with the bookings for them to complete in line with the customer requirements.

The customer will make the booking either by phone, online or face to face contact.

Wherever way these bookings are made, the controller will distribute the jobs by the main port of contact.

The App 

We at West London Cars, use the app called Cab Treasure Gold, all driver are provided with the cab treasure app.

This will enable the controller to send the job to the drivers devices, so that the controller can check the where about of the drivers.

In the same breath the customer will have the drivers details sent to their phone as and when the jobs are distributed. 

The controller can also check whether the driver are in the vicinity of the customer who has submitted a booking request.

Confirmation of bookings

All customer’s will get a text confirmation, letting them know that the booking has been accepted.

Any booking request that has been accepted, we are responsible for and shall provide the vehicle when necessary. 

In addition, we hereby ask all drivers to check, the route planner before the journey. 

Picking up Customers

The driver are responsible for determining the most effective, efficient and safe manner to carry out the booking.

The driver retain the sole right to determine how long to wait for a customer. 

While on the job, all drivers identity badge must be visible for the customer’s to see.

The driver, should not engage into long conversation with the customer, this can lead to distraction and delays.

Fare

Payments are made by either cash or bank cards of any sort.

Cash payment are made directly to the drivers, whereby card payments are made in the office.

These payments are then distributed, to the name driver that completed the said job.

Services given to the customers

  1. West London Cars, aim to complete the booking with care, skill and diligence in accordance with good practice. 
  2. Provide a clean roadworthy and good operating vehicle
  3. Ensure that the vehicle use is not older than 10 years
  4. Make sure that the vehicle that is booked is clean and in sanitary condition.

5. Comply with all applicable laws, and regulations of the government 

6. Make sure at all times the driver is polite and helpful

7. Drivers must wear their badges around their neck, so that the customer can identified them before entering the vehicle. 

Drivers Informations

All drivers working for West London Cars must be 

  1. Over 21 years old
  2. Hold valid proof of identity
  3. Hold a valid National Insurance number
  4. Hold a valid UK driving licence
  5. Hold a valid private hire vehicle driver licence issued by the reference authority
  6. Hold a V5C registration certificate (log book) for the vehicle used to complete booking
  7. Hold a valid MOT
  8. Hold a valid insurance policy
  9. Or any other document requires for private hire 

General Driver Obligations

The driver shall at all times and at their own expenses, be responsible for arranging their own internet or mobile data service in order to access the App. 

The driver are responsible for using a portable electronic device with minimal technical requirements in order to use the App.

All drivers must be aware, using the driver app unlawful in any manner is an act of fraudulent or malicious behaviour. Such behaviour can be harmful to the data in the App.

All drivers are responsible for keeping their password confidential and secure for the app

Cancellations

Following acceptance you may cancel a booking only in certain circumstances.

You agree to fulfil the booking in good faith which shall mean to prevent where possible, any unnecessary ride cancellations / rides prior to reaching the customer’s destination.

You can cancel in any emergency, i.e flat tyre, an accident, breakdown or at risk for any reasons.

West London Cars Obligation to Drivers

In our consideration of us allowing you to use our App and provide you with the booking services, you agree to pay Rent / commission for each booking.

West London Cars, hereby ask that all drivers read these terms carefully before using the Driver App.

These terms set out how we will provide you the sign up details for the drivers App how you receive the jobs, how you and West London Cars may change or end the right to use the driver App and what to do if there is a problem and other important informations.

By registering as a driver to West London Cars you are agreeing to the following terms and conditions.

The terms and Conditions constitute a binding contract between you and West London Cars.

West London Cars is the owner and operator of, West London Cars, and it’s mobile applications developed by West London Cars, from time to time. 

Hereafter, collectively referred to as West London Cars, purposes of this contract, alternately referred to as contract terms and conditions, or agreements.
